Is an Auto Dialer Legal in India? TRAI Rules Explained Simply

In short: Using an auto dialer to call your own customers and opted-in leads from your own SIM is ordinary business calling. What TRAI regulates is unsolicited commercial communication: calling DND-registered numbers or bought lists is where the penalties start.

The question comes up before every auto dialer purchase, and the internet answers it badly, usually either “totally fine” from a vendor or “illegal” from someone who read a headline.

The accurate answer: the dialer is not the regulated thing. The call is.

What is actually regulated

TRAI’s Telecom Commercial Communications Customer Preference Regulations (TCCCPR 2018), amended in February 2025, govern Unsolicited Commercial Communication (UCC). Nothing in them bans automated dialling as a technology. What they control is:

  • Who you may call. Customers can register on the DND / NCPR registry to block commercial calls entirely, or by category: banking and finance, real estate, education, health, consumer goods and automobiles, communication and entertainment, or tourism.
  • Which numbers you call from. Promotional calls must originate from the 140 series; transactional and service calls use the 1600 series.
  • Whether you are registered. Telemarketers are supposed to register and operate through the DLT framework.

The penalties, in real numbers

  • Unregistered entities sending unsolicited commercial communication: fines up to ₹50,000 per violation.
  • Registered telemarketers breaching the rules: graded penalties from ₹1,000 for a first offence, rising to ₹10,000 for repeat breaches.
  • Telecom operators who fail to act on offenders: up to ₹5,00,000 per contravention.

The practical enforcement route is usually simpler and faster than a fine: complaints get your connection barred.

Where most small businesses actually sit

This is the part vendors skip. There is a real difference between:

Service and transactional calling — ringing your own customers about their own order, appointment, renewal or payment. This is not telemarketing. A restaurant confirming a booking, a clinic reminding about an appointment, a shop calling about a repair: ordinary business calls.

Warm leads who asked to hear from you — someone who filled your enquiry form, replied to your ad, or asked for a quotation. You have their consent. Keep evidence of it.

Cold promotional calling to bought lists — this is the regulated activity, this is where DND applies, and this is where the penalties live. “We bought the database” is not a defence; it is closer to an admission.

Most small Indian businesses using an auto dialer are in the first two categories. That is why it is normal business calling, and why an app that dials your own leads from your own SIM is not doing anything exotic.

Does dialling from your own SIM change anything?

Legally, the obligations follow the nature of the call, not the technology. Cold promotional calls are regulated whether they leave a virtual number or a SIM.

Practically, it changes a lot:

  • You are not a registered telemarketer sending bulk promotional traffic through the 140 series; you are a business calling its own contacts from its own number.
  • Your customers see a normal local number, so they are far less likely to report it as spam, and reports are what actually gets connections barred.

That second point matters more than most people expect. Regulatory risk for a small business usually arrives as complaints, not as an inspection.

Staying on the right side of it

  • Call people who asked to hear from you. Keep a record of where each lead came from.
  • Screen against DND before any promotional campaign.
  • Stop when someone says stop, and record that they said it.
  • Do not buy lists. It is the single fastest route to complaints.
  • Keep sensible hours. Not a rule for ordinary business calls, but late-evening calls generate the complaints that create the problem.
  • Register properly if you genuinely do bulk promotional telemarketing.
