How do you use an auto dialer in the USA from a US SIM, step by step?

The SIM, the area code, the list, the check before upload, the session, the hours and the office. Seven steps, in the order they happen.

The SIM

A US SIM on any carrier. Most US plans include unlimited domestic calling, so the calls in a session cost nothing extra. On a dual-SIM phone, put the business number in one slot and tell RMDialer to dial from that slot.

The area code

Choose the number your customers know. A contractor in Phoenix calling Phoenix customers from a 602 or 480 number gets answered; the same list called from an out-of-state number gets screened. The SIM decides the area code, not the app.

The list

Import past customers from a spreadsheet, a Google Sheet, your CRM through the REST API, or the phone's own call log. Keep the columns that matter on a US list: last job date, city, whether the person opted out.

The check before upload

RMDialer does not screen numbers against the National Do Not Call Registry. Do that first, with the registry file from donotcall.gov, for any number that is not covered by a recent customer relationship or written consent.

The session

The word autodialer

What counts as an autodialer under the TCPA after Facebook v. Duguid?

In the United States the word has a legal meaning that is narrower than the product category, and the difference decides a great deal.

The TCPA, passed in 1991, restricts calls to cell phones made with an "automatic telephone dialing system" or an artificial or prerecorded voice unless the person gave the right kind of consent. For thirty years the argument was what that phrase covered. In April 2021 the Supreme Court decided Facebook v. Duguid and held that the equipment must be able to make up the numbers it dials, at random or in sequence. Ringing a stored list of customers, in the order they sit in the list, is not that.

RMDialer is on the list side of that line by construction. It has no random dialling, no sequential dialling and no number generator: the only numbers it can ring are the ones a person imported or typed. It also has no voice of its own, so the prerecorded-voice rule, which the ruling left untouched, does not come into play.

What the ruling did not do is make every list a fair list. The National Do Not Call Registry, the Telemarketing Sales Rule's hours and caller-ID duties, the abandoned-call cap and each state's own law all apply to the call regardless of the tool. The question a US business should ask is not "is this dialer an ATDS" but "may I ring this number today, from this number, at this hour". The table below is that question in six rows.

What do the TCPA autodialer rules, the Do Not Call Registry and the calling hours say?

The telemarketer's number, or the seller's customer service number, must be transmitted to caller ID. Calls from a SIM show the SIM's number by design. The hours are yours to keep; the app does not block a call at 9:15.
Telemarketing Sales Rule: abandoned calls No more than 3% of calls answered by a person may be abandoned, measured per campaign or per 30 days, and the caller must let the phone ring at least 15 seconds or four rings. A one-call-at-a-time dialer cannot abandon a call: the person who pressed start is the person who talks.
State law Several states have telemarketing laws of their own. Some define an autodialer more widely than the federal ruling, some set narrower calling hours, some add a state do-not-call list. Outside the robocall rules

Why does a one-call-at-a-time dialer sit outside the robocall rules, and what does it not do?

The behaviours the rules target are not available to a SIM dialer. The jobs the rules leave to you are still yours.

Read the rules above again and notice what they keep coming back to: numbers nobody chose, voices nobody spoke, calls nobody was free to take, numbers that were hidden. A dialer that rings one loaded number for one waiting person, from the SIM in that person's phone, cannot do any of those four things. That is not a feature RMDialer added for the US market; it is what a phone dialer is.

The other half of the honesty is what the app leaves to you.

  • It does not scrub a list against the National Do Not Call Registry or any state list. That check is done before upload, by you or a screening service.
  • It does not store proof of consent. Keep the form, the invoice or the signed job sheet where you keep your other records; the remark on each customer can note where the number came from.
  • It does not play recorded messages, and it does not dial more than one number at a time. If the plan is a recorded reminder to 5,000 accounts, that is a different product with its own consent rules.

A worked example

How does a roofing contractor in Phoenix call 300 past customers before storm season?

Picture a roofing contractor in Phoenix, Arizona, with two crews and a spreadsheet of 300 past customers going back four years. Every June the monsoon and hail season arrives, and every June the phone rings with people whose roofs he fixed once and who now want an inspection before the storms. He would rather ring them first, in May, from the office, and book the inspections before the rush.

He sorts the sheet by last job date. 170 customers had work done in the last 18 months, so the established business relationship covers a sales call about an inspection. The other 130 are older, so he downloads the registry data for the 602, 480 and 623 area codes from donotcall.gov, which is free for up to five codes, and removes the 22 numbers that appear on it. The remaining 278 go into RMDialer with the last job date and the street as columns. That check took an hour and happened before the app saw a single number.

On Monday morning at nine the office manager picks the business SIM, a 602 number every customer already has in their phone, sets a ten-second gap and presses start. Each customer rings in turn; the screen shows "ridge cap replaced, March, two years ago". Ninety people book an inspection. Forty ask for a call after the weekend, and each becomes a reminder that rings on the manager's phone on the day. Six say they sold the house, and "do not call" is saved on each so they never enter a list again. Nobody was rung before eight or after nine, Arizona time, because the manager works office hours and the app dials when she does.

The contractor reads the week in the Web CRM from his truck: calls, people reached, inspections booked per day, and the callbacks due next Monday. The bill for the year is one seat, $29, and the 300 calls rode on the unlimited minutes the business line already had.

Does an auto dialer for USA work on a US SIM in an Android phone?
