What do auto dialer laws actually regulate?
The law watches the call, not the tool, and the answer depends on whose numbers are in your list. Six things get regulated, and the software is not one of them.
Who you call
Do-not-call registers in the US, UK, India, Australia and Canada let people opt out of unsolicited sales calls. A person who is already your customer, or who asked you to call, is not who those registers are for.
How the call is placed
Random or sequential number generation, calls abandoned because nobody was free to take them, and calling faster than a human could, are the behaviours the rules single out.
Whether a recording speaks
A recorded message played to whoever answers is the most tightly controlled kind of call almost everywhere. A live person speaking is the ordinary kind.
What the call is for
Selling to a stranger is marketing. Confirming an order, chasing an invoice or reminding a client of a renewal is service. Most rules treat the two differently.
When you call
Several countries set calling hours for sales calls. Service calls to your own customers usually fall outside them, but late-evening calls are where complaints start.
What you can show afterwards

The US definition
What is the TCPA autodialer definition after Facebook v. Duguid?
The word autodialer has a narrow legal meaning in the United States, and it is narrower than the product category.
The Telephone Consumer Protection Act restricts calls to mobiles made with an "automatic telephone dialing
system" or with an artificial or prerecorded voice, unless the person consented. For years the argument was what
counted as such a system. In 2021 the Supreme Court settled it in Facebook v. Duguid: the equipment must use a
random or sequential number generator to store or produce the numbers it dials. A system that rings numbers
from a list you loaded, in the order you loaded them, does not meet that definition.
That does not make list dialling a free pass. The prerecorded-voice rule stands on its own, the National Do Not
Call Registry still applies to sales calls to strangers, the FTC's Telemarketing Sales Rule sets calling hours
and abandoned-call limits, and several states have added rules of their own. What the ruling did was draw a
line between a person working a customer list one number at a time and a machine spraying numbers it invented.

Are predictive dialers legal, and are power dialers illegal?
Four kinds of dialer, and where each one stands. The list decides legality; the kind decides how much extra the rules ask of you.
Progressive (power) dialer
Rings one number for one free caller. No abandoned calls by design, a human on every answered call. Legal everywhere for calls you were allowed to make by hand; the list, not the dialer, decides that.
Preview dialer
Waits for the caller to press dial after reading the record. The slowest and least regulated shape there is, because nothing about it is automated except the queue.
Predictive dialer
Rings more numbers than there are free callers. Legal in most countries but regulated: the US, UK, Australia and Canada all limit how many answered calls may be abandoned, and require a message or a callback number when one is.
Recorded-message dialer
Plays a recording to whoever answers. Needs prior consent for marketing almost everywhere, has its own identification and opt-out rules, and is the product most people mean when they ask whether robocalls are illegal.

Do I need consent to call my own customers?
For their own account, no, anywhere on this page. These six habits are what keep every other call on the right side too.
Call people who know you
Customers, enquiries, past buyers, people who left a number at your counter or on your form. They are the list an auto dialer should be pointed at.
Keep where each number came from
The form, the invoice, the walk-in, the referral. If you cannot say how you got a number, do not put it in a list.
Stop when asked, and write it down
A "do not call me" is honoured the same day, marked on the record, and that number is kept out of the next list.
Keep sensible hours
Daytime and early evening in the person's own time zone. Service calls are rarely restricted by the clock, but nobody has ever complained about a call that came at a reasonable hour.
Show your real number
The mobile number the person may already have saved. Hidden and rented numbers are what the caller-ID apps flag and what several rules forbid outright.
One number at a time, a person on the line
No recording, no over-dialling, nobody answering to silence. This is the shape a SIM app has anyway, and it is the shape every rule above is comfortable with.

One agency's decision
How does a debt-collection agency in Sydney decide what it may automate?
An illustration with round numbers, in a trade where the rules on contact are stricter than for ordinary sales.
Picture a debt-collection agency in Sydney with four collectors and 3,000 open accounts placed with it by two
utility companies. A vendor has quoted a recorded-message system: it would ring every account, play a payment
reminder, and offer a keypad option to speak to someone. The owner's question is not "is auto dialer legal" in
general but which parts of that plan the rules allow in Australia.
The Do Not Call Register is not the issue: these are the agency's own placed accounts, not telemarketing. The
issue is the conduct guidance for debt collection from the ACCC and ASIC, which sets contact hours, a cap on how
often a debtor may be contacted in a week and a month, and an expectation that contact is with a person who can
answer questions. A recording that rings every account, some of them for the fourth time that week, walks into
all three. The agency parks the quote.
Instead, each collector's accounts go into RMDialer as a list, with the last contact date and the agreed

What are the TCPA autodialer rules for calling mobiles?

Are predictive dialers legal?
Legal in most countries, and regulated in all of them, because they ring more numbers than there are free callers and some people answer to silence. The US, UK, Australia and Canada each limit how many answered calls may be abandoned and require an identification message or a callback number when one is. Are power dialers illegal to use on a customer list?
No. A power dialer, also called progressive, rings the next number only when a caller is free, so every answered call meets a person at once. Nothing about that is restricted anywhere on this page.
