Consent, market by market

Is it legal to record calls with buyers, tenants and landlords where you work?

General rules as we checked them in September 2026. This is not legal advice; if your agency records every week, ask a local lawyer once.

India

Court rulings have long let a person on a call record it. An agency recording clients also handles personal data under the Digital Personal Data Protection Act 2023 and its Rules notified in November 2025, which expect notice and a stated purpose.

Say at the start that the call is recorded and why, and keep the file only while that reason lasts.

Singapore

The PDPA asks organisations to tell people the purpose for collecting their personal data and to have consent for that purpose. A recorded call with a tenant, buyer or landlord carries exactly that kind of data.

Open with a one-line disclosure and the reason, for example keeping the agreed rent accurate.

United Arab Emirates

Federal Decree-Law No. 34 of 2021 on cybercrime makes recording a private conversation without permission an offence with prison and large fines. Being on the call is not permission, so in practice every person must agree.

Get a clear yes before recording, and never record a call you have not announced.

United Kingdom

UK GDPR applies to business recordings. ICO guidance says callers must be told that the call is recorded and why, and the business needs a lawful basis such as legitimate interests.

Tell them in the first sentence and point them to your privacy notice for the rest.

United States

Federal law is one-party: someone on the call may record it. Several states, among them California, Maryland and Massachusetts, are all-party and need every person's consent, and a call across state lines can bring the stricter rule into play.

Treat every call as all-party: announce it, and carry on only if the other person stays on the line.

How long should a real estate agency keep call recordings?

As long as the reason for recording lasts, and not much longer. The reason sets the retention period, never the size of the phone.

A recording made to settle the agreed rent has done its work once the tenancy agreement is signed and the deposit paid; one kept for a commission promise matters until the fee arrives. Holding every call forever just in case turns a useful habit into a pile of sensitive files nobody can defend.

How would a Singapore rental agent have settled an agreed rent dispute with RMDialer?

Picture a small agency in Singapore handling HDB flat rentals, condo leases and the odd resale.
